General Commitments

We understand that international B2B disputes between parties from different countries within the EU require speed and cost efficiency, predictability and transparency. Until now, this has not always been available for Mid-Sized (200 kEUR  – 2 mEUR) B2B conflicts in Spain.
The goal of the ADR Circle Spain is to offer especially to foreign corporations a conflict resolution system “ADR Negotiation, Mediation and Arbitration” which is strictly business oriented and fit for any international B2B conflict. Accordingly the ADR Circle commits to the following:
We aim to settle a conflict using whichever conflict resolution procedure best fits the individual conflict at hand. We are prepared to offer the possible use of any and all conflict resolution procedures when a dispute arises, keeping an open mind to the use of a range of conflict resolution techniques.


Controlled Quality

We strive for continuous training of our members in order to constantly improve procedures: collaborative, mediation and arbitration best practices. We invite our members and non-member companies, institutions or experts to openly discuss wishes and needs of any (international) B2B conflict partners in order to understand and transfer these into our procedures. Of course, the quality and expertise of each counsellor goes without saying; however the quality of any negotiator, mediator or arbitrator and the responsible “in-house-team” is also vital to us. Therefore, after any negotiation, mediation and arbitration, we carry out a posterior review of the result through an independent peer group (universities and research institutions).
Speed in Negotiation - Mediation – Arbitration
Our general intent is to resolve conflicts through negotiation/mediation within a maximum of 3 working days and we aim to resolve mid-sized international B2B arbitration situations within 9 months using standardized procedures, communications and templates.


Cost Limitation

The ADR Circle Spain is committed to enable a “maximum cost risk-calculation” in case of international arbitration based on established fixed amounts. The counsellors of the ADR Circle offer to include maximum limits in the event of reimbursement. Moreover the arbitrators apply the principle of proportionality in case of reimbursement according to the adjudicated result of the conflict solution.
